Terms of Service for Skyintel Weather Forecast

Welcome to Skyintel Weather Forecast ("Skyintel," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of the Skyintel website, applications, and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Service.

Please read these Terms carefully before using our Service. Your continued use of the Service constitutes your acceptance of these Terms and any future amendments. We reserve the right to update or modify these Terms at any time without prior notice. The most current version of the Terms will always be available on this page. 1. Description of Service

Skyintel Weather Forecast provides users with access to meteorological information, including but not limited to current weather conditions, hourly forecasts, 7-day forecasts, extra forecast details (such as wind speed, humidity, UV index, visibility, pressure, sunrise/sunset times), Air Quality Index (AQI), weather radar/maps, graphical charts, severe weather alerts, weather advisories, weather-based recommendations, and seasonal/travel weather planning content. Additionally, the Service may include news and articles related to climate and environment, user-generated content (photos/videos), and live weather camera feeds where available.

Our Service is intended for informational purposes only. While we strive to provide accurate and timely weather data, all forecasts and information are derived from complex scientific models and real-time observations, which are inherently subject to change and uncertainty. Therefore, Skyintel cannot guarantee the absolute accuracy, completeness, or reliability of any information provided. Users should exercise their own judgment and discretion when relying on the Service for any decisions, especially those pertaining to personal safety, property, or critical activities. We recommend consulting official government weather agencies or local authorities for critical weather information and warnings.

The Service may evolve over time, with new features being added and existing features being modified or removed. We reserve the right to update, modify, or discontinue any aspect of the Service at our sole discretion, without prior notice or liability to you. We aim to provide a continuous and reliable service but cannot guarantee uninterrupted access due to technical issues, maintenance, or other unforeseen circumstances.

2. User Accounts

While much of Skyintel's content is accessible without an account, certain features, such as personalized alerts, saving preferred locations, or contributing user-generated content, may require you to register for an account. When creating an account, you agree to:

Provide accurate, current, and complete information as prompted by the registration form.
Maintain and promptly update your account information to keep it accurate, current, and complete.
Maintain the security of your password and identification.
Accept all risks of unauthorized access to your account and the information you provide to us.
Notify us immediately of any unauthorized use of your account or any other breach of security.

You are solely responsible for all activities that occur under your account, whether or not you authorized such activity. Skyintel will not be liable for any loss or damage arising from your failure to comply with these obligations. We reserve the right to suspend or terminate your account at our sole discretion if we suspect any breach of these Terms or for any other reason deemed necessary.

3. Intellectual Property Rights

All content, features, and functionality on the Service, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and the compilation thereof (the "Content"), are the exclusive property of Skyintel Weather Forecast, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its Content for your personal, non-commercial use only, subject to these Terms. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the Content on our Service, except as follows:

Your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials.
You may store files that are automatically cached by your Web browser for display enhancement purposes.
You may print or download one copy of a reasonable number of pages of the Service for your own personal, non-commercial use and not for further reproduction, publication, or distribution.

Using any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
Using any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent.
Using any device, software, or routine that interferes with the proper working of the Service.
Introducing any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
Attempting to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
Attacking the Service via a denial-of-service attack or a distributed denial-of-service attack.
Otherwise attempting to interfere with the proper working of the Service.
Collecting or storing personal data about other users without their express permission.
Impersonating or attempting to impersonate Skyintel, a Skyintel employee, another user, or any other person or entity.
Engaging in any other conduct that we, in our sole discretion, deem inappropriate or harmful.

Any violation of these conduct rules may result in the immediate termination of your access to the Service and may subject you to legal penalties.

5. Content You Provide

The Service may allow you to submit, upload, publish, or otherwise make available content, including but not limited to photos, videos, comments, and feedback ("User Content"). When you submit User Content, you retain ownership of any intellectual property rights that you hold in that content. However, by making any User Content available through the Service, you grant to Skyintel a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, publicly perform, and publicly display such User Content in any media formats and through any media channels now known or hereafter developed, for the purposes of operating, promoting, and improving the Service.

You represent and warrant that:

You are the sole and exclusive owner of all User Content that you make available through the Service or you have all rights, licenses, consents, and releases that are necessary to grant to Skyintel the rights in such User Content, as contemplated under these Terms.
Neither the User Content nor your posting, uploading, publication, submission, or transmittal of the User Content or Skyintel's use of the User Content (or any portion thereof) will infringe, misappropriate, or violate a third party's patent, copyright, trademark, trade secret, moral rights, or other proprietary or intellectual property rights, or rights of publicity or privacy, or result in the violation of any applicable law or regulation.

You agree not to provide User Content that:

Is defamatory, obscene, indecent, abusive, offensive, harassing, violent, hateful, inflammatory, or otherwise objectionable.
Promotes sexually explicit or pornographic material, violence, or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age.
Infringes any patent, trademark, trade secret, copyright, or other intellectual property or other rights of any other person.
Violates the legal rights (including the rights of publicity and privacy) of others or contain any material that could give rise to any civil or criminal liability under applicable laws or regulations or that otherwise may be in conflict with these Terms and our Privacy Policy.
Is likely to deceive any person.
Promotes any illegal activity, or advocates, promotes, or assists any unlawful act.
Causes annoyance, inconvenience, or needless anxiety or be likely to upset, embarrass, alarm, or annoy any other person.
Impersonates any person, or misrepresents your identity or affiliation with any person or organization.
Involves commercial activities or sales, such as contests, sweepstakes, and other sales promotions, barter, or advertising.
Gives the impression that they emanate from or are endorsed by us or any other person or entity, if this is not the case.

Skyintel reserves the right to remove or refuse to post any User Content for any reason or no reason, including if we believe that the User Content violates these Terms.

6. Third-Party Links and Services

The Service may contain links to third-party websites, advertisers, services, or resources that are not owned or controlled by Skyintel. These links are provided for your convenience and informational purposes only. Skyintel has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We do not warrant the offerings of any of these entities/individuals or their websites.

You acknowledge and agree that Skyintel shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such third-party websites or services. Your interactions with third-party organizations and individuals found through the Service are solely between you and such organizations and individuals. You should make whatever investigation you feel necessary or appropriate before proceeding with any online or offline transaction with any of these third parties. We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

7. Disclaimer of Warranties

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. SKYINTEL EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

SKYINTEL MAKES NO WARRANTY THAT:

THE SERVICE WILL MEET YOUR REQUIREMENTS;
THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE;
THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE;
THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS; AND
ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED.

ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICE IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OF ANY SUCH MATERIAL.

NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM SKYINTEL OR THROUGH OR FROM THE SERVICE SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SKYINTEL, ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE;
ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE;
ANY CONTENT OBTAINED FROM THE SERVICE; AND
UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

THIS LIMITATION OF LIABILITY APPLIES TO, BUT IS NOT LIMITED TO, DAMAGES ARISING FROM ERRORS, OMISSIONS, INTERRUPTIONS, DEFECTS, DELAYS IN OPERATION OR TRANSMISSION, COMPUTER VIRUSES, FILE CORRUPTION, COMMUNICATION LINE FAILURE, NETWORK OR SYSTEM OUTAGE, OR THEFT, DESTRUCTION, UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF ANY RECORD.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF SKYINTEL AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS TO YOU FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE AMOUNT YOU PAID, IF ANY, TO SKYINTEL FOR ACCESS TO THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. IN SUCH JURISDICTIONS, SKYINTEL'S LIABILITY WILL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

9. Indemnification

You agree to indemnify, defend, and hold harmless Skyintel, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

Your violation of these Terms of Service.
Your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms.
Your negligence or willful misconduct.
Your violation of any rights of another party, including intellectual property rights.
Any third-party claim arising from or related to your use of the Service.

This indemnification obligation will survive the termination of these Terms and your use of the Service. Skyintel reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you will cooperate with Skyintel in asserting any available defenses.

10. Termination

We may terminate or suspend your access to all or part of the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

11. Governing Law and Jurisdiction

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall be exclusively settled by the courts located in New Delhi, India. You hereby irrevocably consent to the exclusive jurisdiction and venue of such courts in connection with any such dispute.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

12. Dispute Resolution

In the event of any dispute or claim arising out of or relating to these Terms or your use of the Service, you agree to first attempt to resolve the dispute informally by contacting Skyintel's customer support. We will endeavor to resolve the dispute through good faith negotiations.

If a dispute cannot be resolved informally within sixty (60) days of the initial contact, either party may initiate legal proceedings. As stated in Section 11, such proceedings shall be exclusively brought in the courts located in New Delhi, India.

This clause does not prevent either party from seeking injunctive or other equitable relief from a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable. The unenforceability or invalidity of any provision shall not affect the enforceability or validity of any other provision of these Terms.

14. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by Skyintel on the Service, constitute the entire agreement between you and Skyintel concerning the Service and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written, between you and Skyintel with respect to the Service. Any waiver of any provision of these Terms will be effective only if in writing and signed by a duly authorized representative of Skyintel.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service. We encourage you to periodically review these Terms to stay informed of our updates.
